Kryostasis offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing a high-performance recovery system from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms, conditions, and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Due to the extreme temperatures and physical demands associated with cold-water immersion systems, our products and Services are strictly restricted to adults.
  • Lawful Use: You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
  • Enforcement & Restrictions: We reserve the right to suspend or terminate access to the Service for violations of these Terms.

2. PRODUCTS, PRICING & AVAILABILITY

  • Pricing Adjustments: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
  • Product Availability: All descriptions of products, specifications, and pricing are subject to change at any time without notice, at our reasonable discretion. While we strive for accuracy, we cannot guarantee that all items will be continuously in stock or available for immediate preparation at the time of order placement.
  • Transaction Verifications: Because our equipment represents a high-ticket financial transaction, Kryostasis reserves the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

3. INCORPORATION OF SITE POLICIES

Your purchase, delivery, and warranty parameters are governed by a network of specific operational guidelines. The following documents are fully incorporated into these Terms of Service by reference and constitute a binding contractual agreement:

  • Limited Warranty: Establishes the parameters, exclusions, and remedies for factory defects.
  • Shipping Policy: Outlines Curbside LTL Freight delivery procedures, inspection requirements, and risk transfer.
  • Return, Refund & Cancellation Policy: Governs fee structures, 7% pre-shipment cancellation charges, and 25% restocking fees.
  • Privacy Policy: Governs the collection, use, and disclosure of your personal information

4. ACCURACY OF BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, phone number, and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. In accordance with our Shipping Policy, unreachable contact data or address errors may result in carrier storage fees billed entirely to the customer.

5. INTELLECTUAL PROPERTY

All content on this website, including but not limited to text, graphics, logos, product designs, images, videos, trademarks, software, and other materials, is owned by or licensed to Kryostasis LLC and is protected by applicable intellectual property laws. No content may be copied, reproduced, distributed, modified, or used without prior written permission from Kryostasis LLC.

6. MEDICAL AND SAFETY DISCLAIMER (CRITICAL)

COLD WATER IMMERSION AND EXTREME TEMPERATURE EXPOSURE CARRY INHERENT PHYSICAL RISKS.

  • Consultation Required: You expressly acknowledge and agree that Kryostasis products are heavy-duty wellness appliances designed for healthy adult populations. You must consult with a licensed physician before using any Kryostasis cold plunge or chiller system, especially if you have pre-existing health conditions, including but not limited to cardiovascular disease, high blood pressure, diabetes, neuropathy, open wounds, or pregnancy.
  • Assumption of Risk: By purchasing and operating our equipment, you voluntarily assume all physical risks associated with cold therapy, including hypothermia, frostbite, thermal shock, or cardiac events. To the maximum extent permitted by applicable law, Kryostasis shall not be liable for personal injuries or medical complications resulting from improper use, excessive exposure times, or failure to monitor physiological thresholds.

7. PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

  • For any unlawful purpose;
  • To solicit others to perform or participate in any unlawful acts;
  • To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others;
  • To submit false or misleading information;
  • To upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service.

8. FORCE MAJEURE

Kryostasis shall not be liable for any delay or failure to perform resulting from events beyond its reasonable control, including, but not limited to, natural disasters, labor disputes, carrier interruptions, government actions, war, pandemics, supply chain disruptions, or failures of third-party providers.

9. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

  • Service Delivery: We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
  • Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall Kryostasis LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.
  • Liability Cap: Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. Total aggregate liability under these Terms shall not exceed the original dollar amount paid by the customer for the specific product causing the claim.

10. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Kryostasis LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

11. DISPUTE RESOLUTION: MANDATORY BINDING ARBITRATION & CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

  • Individual Arbitration: You and Kryostasis LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service, your purchase of products, or the breach, termination, enforcement, interpretation, or validity thereof, shall be settled exclusively by binding, individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
  • Class Action Waiver: YOU AND KRYOSTASIS FORMALLY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
  • Location: Judgment on the award rendered by the arbitrator may be entered in any court having competent jurisdiction.

12. GOVERNING LAW

These Terms of Service, along with all incorporated operational policies, and any separate agreements whereby we provide you Services shall be governed by, interpreted, and enforced strictly in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

13. SEVERABILITY AND TERMINATION

  • Severability: In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
  • Termination: The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
